DMCA & Copyright Policy

Our commitment to protecting intellectual property rights and complying with the Digital Millennium Copyright Act.

DMCA Compliance

avfile.io respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond expeditiously to claims of copyright infringement committed using our Service that are reported to our designated copyright agent.

It is our policy to expeditiously respond to clear notices of alleged copyright infringement that comply with the DMCA. We will disable access to or remove content that we believe in good faith to be infringing, and we will terminate the access of users who are found to be repeat infringers. This DMCA policy applies to all content hosted on or transmitted through avfile.io, including files uploaded by users and any other material available through our Service.

If you are a copyright owner or an agent thereof, and you believe that any content hosted on avfile.io infringes your copyrights, you may submit a notification pursuant to the DMCA by providing our designated copyright agent with the information described below. Please note that you may be liable for damages, including costs and attorneys' fees, if you materially misrepresent that material is infringing.

How to File a DMCA Notice

To file a DMCA takedown notice with avfile.io, you must provide a written communication that includes the following elements:

  • Identification of the copyrighted work: A description of the copyrighted work that you claim has been infringed. If multiple copyrighted works are covered by a single notification, you may provide a representative list of such works.
  • Identification of the infringing material: The URL or link to the specific file on avfile.io that you claim is infringing, together with enough information to allow us to locate the material on our Service.
  • Your contact information: Your full name, mailing address, telephone number, and email address so that we can contact you regarding your claim.
  • Statement of good faith: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • Statement of accuracy: A statement, under penalty of perjury, that the information in the notification is accurate, and that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  • Physical or electronic signature: A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright that has been allegedly infringed.

Counter-Notification Process

If you believe that your content was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification pursuant to the DMCA. To be effective, a counter-notification must include the following:

  • Identification of the specific material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access to it was disabled.
  • A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
  • Your name, address, telephone number, and a statement that you consent to the jurisdiction of the federal court in your district (or the district where your service provider is located) and that you will accept service of process from the person who provided the original DMCA notification.
  • Your physical or electronic signature.

Upon receipt of a valid counter-notification, we will forward a copy to the original complaining party and restore the removed content within 10 to 14 business days, unless the copyright owner files an action seeking a court order against the content provider or user. Counter-notifications may be submitted via email to avfile.io@gmail.com.

Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material was removed or disabled by mistake or misidentification may be subject to liability.

Repeat Infringer Policy

In accordance with the DMCA, avfile.io has adopted a policy of terminating access for users who are found to be repeat infringers. A "repeat infringer" is defined as a user who has had content removed from the Service on two or more occasions due to valid DMCA takedown notices. When we determine that a user is a repeat infringer, we will permanently terminate their access to the Service and remove all content associated with their account.

We track DMCA complaints and counter-notifications to ensure that this policy is applied fairly and consistently. We also take into account the results of any counter-notifications when determining whether a user qualifies as a repeat infringer. If you believe that a DMCA takedown notice was filed against you in error, we encourage you to file a counter-notification to protect your rights.
